1. Agreement to Terms
By booking services with Barry Marries (“we,” “us,” “our,” or “Company”) or using our website barrymarries.com, you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not book our services or use our website.
2. Services Offered
We provide professional officiating and DJ services for weddings, events, and celebrations, including but not limited to:
- Wedding ceremony officiating
- Reception and event DJ services
- Sound system setup and operation
- Music consultation and playlist creation
- Master of ceremonies services
3. Booking and Contract Formation
3.1 Booking Process
A booking is confirmed when:
- You submit a completed booking request
- We provide a written confirmation and service agreement
- You sign the service agreement
- Required deposit payment is received
3.2 Service Agreement
All bookings require a signed service agreement that specifies:
- Event date, time, and location
- Services to be provided
- Total cost and payment schedule
- Special requests or requirements
4. Payment Terms
4.1 Deposit Requirements
- Standard Booking: A 50% deposit is required within 30 days of booking confirmation
- Short-Notice Booking: If your event is scheduled within 30 days of the booking date, full payment is required immediately upon booking
4.2 Final Payment
- Remaining balance is due 14 days before the event date
- Late payment may result in service cancellation at our discretion
- All payments are non-refundable except as specified in the cancellation policy
4.3 Payment Methods
We accept payments via:
- Credit/debit cards
- Bank transfers
- Certified checks
- Cash (in-person only)
4.4 Additional Charges
Additional fees may apply for:
- Travel beyond 25 miles from our base location
- Extended service hours beyond the agreed timeframe
- Additional equipment requests made after contract signing
- Overtime charges for events running beyond scheduled end time
5. Cancellation and Refund Policy
5.1 Client Cancellation
- More than 30 days before event: Full refund of all payments made, less 10%
- 30 days or less before event: No refund available
- Force majeure events: Refunds handled on a case-by-case basis (see Section 10)
5.2 Company Cancellation
If we must cancel due to illness, emergency, or circumstances beyond our control:
- Full refund of all payments made, OR
- Assistance in securing a qualified replacement service provider
- We are not liable for additional costs incurred due to rebooking
5.3 Refund Processing
Approved refunds will be processed within 14 business days using the original payment method.
6. Event Day Responsibilities
6.1 Client Responsibilities
You agree to:
- Provide accurate event details and timeline
- Ensure venue access and adequate electrical power
- Provide a safe working environment
- Communicate any changes at least 48 hours in advance
- Designate a point of contact for the event day
6.2 Our Responsibilities
We agree to:
- Arrive at the agreed time and location
- Provide professional services as outlined in the agreement
- Bring necessary equipment in working condition
- Dress appropriately for the event
- Conduct services in a professional manner
7. Equipment and Technical Requirements
7.1 Our Equipment
We provide and maintain professional-grade audio equipment. Equipment failure does not constitute grounds for refund if backup solutions are implemented.
7.2 Venue Requirements
The venue must provide:
- Adequate electrical power (standard 110V outlets)
- Covered area for equipment during outdoor events
- Reasonable access for equipment setup
7.3 Setup and Breakdown
We require access to the venue for setup at least 1 hour before the event start time and 30 minutes after the event for equipment breakdown.
8. Intellectual Property and Music Licensing
8.1 Music Rights
We maintain appropriate music licensing through performing rights organizations. You are responsible for any special music requests that may require additional licensing.
8.2 Recording and Photography
We may take photos or recordings of our setup and services for promotional purposes unless you specifically request otherwise in writing.
9. Limitation of Liability
9.1 Service Limitations
Our liability is limited to the total amount paid for our services. We are not responsible for:
- Venue-related issues or restrictions
- Other vendors’ performance or failures
- Weather-related complications
- Guest behavior or satisfaction
- Consequential or indirect damages
9.2 Equipment Coverage
We carry liability insurance for our equipment. Damage to venue property caused by our negligence is covered up to policy limits.
10. Force Majeure
Neither party is liable for delays or failure to perform due to circumstances beyond reasonable control, including but not limited to:
- Natural disasters
- Government restrictions or regulations
- Public health emergencies
- Venue closures or restrictions
In such cases, we will work with you to reschedule or provide alternative solutions.
11. Modifications and Changes
11.1 Service Changes
Changes to services, date, or time must be requested in writing at least 48 hours before the event. Additional charges may apply for significant changes.
11.2 Terms Modifications
We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Bookings made before changes take effect are governed by the Terms in place at the time of booking.
12. Privacy and Data Protection
Your personal information is handled according to our Privacy Policy, which is incorporated by reference into these Terms.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of Missouri.
13.2 Dispute Resolution Process
Any disputes will be resolved through:
- Good faith negotiation
- Mediation (if negotiation fails)
- Binding arbitration (if mediation fails)
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms, together with your signed service agreement, constitute the entire agreement between you and Barry Marries. No verbal agreements or promises modify these Terms.
